Terms of Service

Please read these Terms of Service carefully before booking with Picture Perfect Events LLC. By submitting a booking and paying your deposit, you agree to be bound by these terms. These terms apply to all photo booth rental services provided by Picture Perfect Events LLC ("Company") to you ("Client").

1. Services

Company agrees to provide photo booth rental services for the event described at the time of booking, including the selected package(s) and any add-ons chosen. Services will be rendered on the confirmed event date and time. Company will arrive no less than 60 minutes prior to the event start time to complete setup.

2. Payment — Non-Refundable Deposit

A non-refundable deposit of $50.00 is required at the time of booking to reserve the event date. This deposit is applied toward the total package price. The deposit is non-refundable under any circumstances, including Client-initiated cancellation.

3. Payment — Remaining Balance

The remaining balance (total package price minus the $50.00 deposit) is due no later than seven (7) days prior to the event date. Company will send a payment reminder to the email address on file. Failure to remit the remaining balance by the due date may result in cancellation of services and forfeiture of the deposit.

4. Travel Fee

Events located more than one (1) hour driving time from Des Moines, Iowa are subject to a travel fee of $0.67 per mile (one-way distance from Des Moines). This fee is calculated at the time of booking and displayed before payment is collected. The travel fee is included in the remaining balance and subject to the same payment terms.

5. Cancellation & Refund Policy

Cancellations must be submitted in writing via email to Company. The following schedule applies:

Company reserves the right to cancel services due to circumstances beyond its control (see Section 9). In such cases, Client will receive a full refund of all amounts paid.

6. Client Responsibilities — Setup Space

Client agrees to provide a safe, clean, and accessible setup area of at least 10' × 10' with a level surface, adequate lighting, and access to a standard 110V electrical outlet within 25 feet of the setup area. Client is responsible for ensuring the venue permits photo booth operations. Company is not liable for inability to perform services due to venue restrictions or insufficient setup space.

7. Outdoor Events

Photo booth equipment is not weatherproof. For outdoor events, Client must provide adequate overhead shade and shelter to protect equipment from direct sunlight, rain, and wind at all times. The Outdoor Tent add-on is required unless Client can guarantee equivalent shade through a third-party structure. Company reserves the right to refuse setup or discontinue services during severe or threatening weather conditions without penalty.

8. Damage to Equipment

Client is responsible for any damage to Company equipment caused by Client, Client's guests, or third parties during the event. Client agrees to reimburse Company for the reasonable cost of repair or replacement of any damaged equipment. Normal wear and tear is excluded.

9. Force Majeure & Equipment Malfunction

Company shall not be held liable for failure to perform services due to circumstances beyond its reasonable control, including but not limited to acts of God, severe weather, fire, flood, power failure, acts of government, or pandemic restrictions. In the event of an equipment malfunction that prevents service delivery, Company's sole liability is a full refund of all amounts paid by Client. Company will make every reasonable effort to remedy equipment issues on-site.

10. Limitation of Liability

In no event shall Company be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to these Terms, including but not limited to loss of enjoyment, emotional distress, or loss of business opportunity. Company's total liability shall not exceed the total amount paid by Client to Company.

11. Photos & Promotional Use

Client acknowledges that photos and content captured at the event may be used by Company for marketing, advertising, and promotional purposes, including on social media, the Company website, and printed materials, unless Client submits a written opt-out request to Company prior to the event date. Company will not disclose personal identifying information of guests without consent.

12. Booking Approval

Submission of a booking request and payment of the deposit does not guarantee confirmation of services. All bookings are subject to review and approval by Company. If Company is unable to fulfill the booking, a full refund of the deposit will be issued within 5 business days.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Iowa. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, binding arbitration in Polk County, Iowa.

14. Changes to These Terms

Company reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes are posted constitutes acceptance of the revised terms. For bookings already confirmed, the terms in effect at the time of booking apply.
